Does Copyright Law Apply to Churches?
Yes, but in general the same rules apply to churches as to anyone else. Churches need to get permission, as do others,
to photocopy, reproduce in bulletins, make transparencies, project from a computer onto a screen, or show a video clip.

What Is Not "In Copyright" and What Is "In the Public Domain"?
Copyright subsists in a work during the lifetime of the author, through the end of the calendar year in which the author
dies and for a period of 70 years following that year. If there are multiple authors, the same terms of copyright apply to
the last surviving author. In cases where authorship is unknown or where it belongs to a corporate body, the rules are
slightly different. Copyright may not apply for a number of reasons: the place of citizenship of the author or the country
of origin of the work may not be signatory to a treaty to which Canada is also a signatory; the term of copyright may
have expired; or the owner of the copyright may have assigned the copyright to the public. In these cases, the
work is said to be "in the public domain." Extreme caution in the reproduction of public domain material is required
because editors, composers, and others, when publishing such material, sometimes introduce their own alterations
that are in copyright. For example, part of a text or harmonization may be in copyright while the melody and most of the

The use of depictions of living or deceased persons may be restricted by laws regarding personality rights. The extent
of these restrictions depends on jurisdiction. Personality rights restrictions apply independently of copyright. We
use most of the time Wikipedia.org photos under  the Wikimedia Commons a freely licensed media file repository.

copyright policy states that "NASA material is not protected by copyright unless noted".
Copyright issues in worship
The performance of works in copyright (for example, playing music) as part of an act of worship is specifically exempted
from copyright laws in several countries.

Problems began to arise during the 1970s, when large numbers of new worship songs were written and became popular
in many churches. Managing these songs was difficult, as churches typically used material drawn from a number of
songbooks, and new publications were released frequently. It became common practice for churches to either create their
own songbook, to include songs on a service sheet, or to project the songs using an overhead projector. (Slide
projectors were occasionally used in the early days, and today the use of a video projector is more common). All these
options required making a copy of the lyrics, an act which was in breach of copyright law.

The same issues arose for church musicians, who needed a collection of music books. Frequently, they resorted to
photocopying music, which again is a breach of copyright law.

To undertake this legally would previously have required a church to obtain permission from all the copyright holders,
a time-consuming and potentially costly process.

CANADA It is not an infringement of copyright

(a) for an author of an artistic work who is not the owner of the copyright in the work to use any mould, cast, sketch, plan,
model or study made by the author for the purpose of the work, if the author does not thereby repeat or imitate the
main design of the work;

(b) for any person to reproduce, in a painting, drawing, engraving, photograph or cinematographic work

(i) an architectural work, provided the copy is not in the nature of an architectural drawing or plan, or

(ii) a sculpture or work of artistic craftsmanship or a cast or model of a sculpture or work of artistic craftsmanship, that is
permanently situated in a public place or building;

(c) for any person to make or publish, for the purposes of news reporting or news summary, a report of a lecture given
in public, unless the report is prohibited by conspicuous written or printed notice affixed before and maintained during
the lecture at or about the main entrance of the building in which the lecture is given, and, except while the building is
being used for public worship, in a position near the lecturer;

(d) for any person to read or recite in public a reasonable extract from a published work; or

(e) for any person to make or publish, for the purposes of news reporting or news summary, a report of an address of a
political nature given at a public meeting.

(2) It is not an infringement of copyright for a person to do any of the following
acts without motive of gain at any agricultural or agricultural-industrial exhibition
or fair that receives a grant from or is held by its directors under federal,
provincial or municipal authority:

(a) the live performance in public of a musical work;

(b) the performance in public of a sound recording embodying a musical work or
a performer's performance of a musical work; or

(c) the performance in public of a communication signal carrying

(i) the live performance in public of a musical work, or

(ii) a sound recording embodying a musical work or a performer's performance
of a musical work.

(3) No religious organization or institution, educational institution and no
charitable or fraternal organization shall be held liable to pay any compensation
for doing any of the following acts in furtherance of a religious, educational or
charitable object:

(a) the live performance in public of a musical work;

(b) the performance in public of a sound recording embodying a musical work or
a performer's performance of a musical work; or

(c) the performance in public of a communication signal carrying

(i) the live performance in public of a musical work, or

(ii) a sound recording embodying a musical work or a performer's performance of a musical work.
